The head lawyer for TikTok, Erich Andersen, is changing positions within the company. Starting in June, he’ll focus on trying to stop the U.S. government from forcing TikTok to sell itself.
A new law signed by President Biden this week gives TikTok’s Chinese parent company, ByteDance, 270 days to sell TikTok’s U.S. operations or face a ban. TikTok says they will sue the government to fight this law.
Andersen has experience with this kind of situation. He helped TikTok win legal challenges against the Trump administration in 2020 and the state of Montana in 2023 that tried to ban TikTok.
TikTok says they don’t share user information with the Chinese government and won’t in the future. They plan to argue that the new law violates the First Amendment, which protects free speech. TikTok users might also sue the government.
The CEO of TikTok, Shou Zi Chew, is confident they will win the lawsuit. A possible ban would affect over 170 million Americans who use the app.
The new law is based on concerns from U.S. lawmakers that China could use TikTok to access user data or spy on them. This fight over TikTok is part of a larger battle between the U.S. and China over technology and the internet.
